§ 1 Scope of services
1.1 The trade fair accommodation agency Anyroomdirect Ihn. Alexander Protsenko (hereinafter referred to as the Agent) exclusively arranges private rooms, flats and houses for the trade fairs taking place in Hanover on behalf of the Landlord.
1.2 When the Agent acts as an intermediary, the Tenant and the Landlord become parties to the accommodation contract. No contract for accommodation is created between the guest and the agent. Neither the Tenant nor the Landlord may make any claim for orders that have not been brokered.
1.3 The Agent and the Host are not tour operators within the meaning of § 651 BGB.
§ 2 Conclusion of contract, payment
2.1 The guest receives the contact details of the landlord with the written booking confirmation.
2.2 Upon conclusion of the contract (receipt of the reservation/booking confirmation), the guest undertakes to pay the total amount by bank transfer to Anyroomdirect no later than 14 days after receipt of the invoice, unless otherwise agreed between the parties.
2.3 All offers are subject to change and non-binding. Price increases during the contract period are excluded. All prices are final prices including the agency fee.
§ 3 Cancellation and non-utilisation
3.1 Cancellation of the accommodation contract must be made in writing.
3.2 In the event of cancellation, the host is entitled to demand a lump-sum compensation.
The following conditions apply:
a) Free cancellation upon receipt of the withdrawal up to 41 days before the booking period
b) upon receipt of the cancellation from 40 to 31 days before the booking period, the guest must pay 40% of the accommodation fee
c) upon receipt of the cancellation from 30 to 21 days before the booking period, the guest must pay 60% of the accommodation fee
d) upon receipt of the cancellation from 20 to 7 days before the booking period, the guest must pay 80% of the accommodation fee
e) In the event of cancellation between the 6th day and the start of the booking period, the guest must pay 100% of the accommodation fee.
f) The lump-sum compensation is due for payment upon receipt of the cancellation.
§ 4 Data protection
4.1 The Agent collects and stores the Guest’s data in accordance with § 28 BDSG in order to fulfil its duties as an agent.
4.2 By submitting the contact details in the booking form, the guest agrees that his/her data will be forwarded to the host of the selected accommodation.
4.3 In addition, the Agent undertakes to treat all data obtained from the Guest as confidential. In particular, the agent excludes any forwarding of the data to third parties for advertising purposes.
§ 5 Liability / Exclusion of liability
5.1 The Agent shall be liable solely for his agency activities. When describing the property, the Agent relies on the accuracy of the information provided by the Host.
5.2 The contractual property may only be occupied by the number of persons stated in the contract. Deviations from this require prior written agreement with the Agent.
5.3 The guest undertakes to treat the property with care, also on behalf of their fellow travellers.
5.4 The guest must hand over the private accommodation clean and in perfect condition on departure.
§ 6 Severability clause
Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions.
